This Privacy Policy describes how Drake collects and uses the personal information you provide on Our Web Sites and Services. It also describes the choices available to you regarding our use of your personal information, how you can access and update this information, and Drake’s relationship with affiliates (“Providers”). 

This Privacy Policy covers Drake’s and/or its Provider’s (collectively “Drake, We, Us and Our”) collection, use and disclosure of information you provide through Our Web Sites and Services. The use of information collected through Our Web Sites and Services shall be limited to the purpose of providing and improving Our Web Sites and Services & providing the service for which the Client engaged Drake. By using Our Web Sites and Services, you agree to the collection and use of information in accordance with this Privacy Policy.

Service Provider Collection/Use

Our Web Sites and Services are sometimes offered by Providers through a white-label agreement or similar agreement. In these cases, Drake acts as a service provider and has no direct relationship with the individuals whose personal information it processes under the direction of the Provider. If you access Our Web Sites and Services through a Provider’s website or other sign-in method unique to the Provider, you are a customer of the Provider. If you would no longer like to be contacted by the Provider, contact the Provider directly to unsubscribe from their contact services.  If requested to remove data we will respond within a reasonable timeframe. We may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our Providers.

We will retain personal data we process on behalf of our Providers for as long as needed to provide services to our Providers. Drake will retain this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Choice/Opt-Out

You may choose to stop receiving our newsletter emails or marketing emails by following the unsubscribe instructions included in these emails or you can contact us at support@1040.com.  If you choose to stop receiving our newsletter emails or marketing emails, we will continue to send you necessary service and transactional communications.

Third Party Information

If you provide us personal information about others, or if others give us your personal information such as name, Social Security number and date of birth for tax filing purposes, we will only use that information for the specific reason for which it was provided to us.

Information Sharing

We will share your personal information with third parties only in the ways that are described in this Privacy Policy. We do not sell your personal information to third parties.

We may provide your personal information to companies that provide services to help us with our business activities such as a credit card processing company to bill you for services, an email service provider to send out emails on our behalf, or a W2 import service to import your W2 information. These companies are authorized to use your personal information only as necessary to provide these services to us.

In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Cookies and Other Tracking Technologies

We, along with our service partners, use cookies or similar technologies. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

We use cookies for remembering user settings. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features or areas of our site may be limited.

Social Media Features

Our Web Sites and Services include Social Media Features, such as the Facebook Like button. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.

Testimonials/Feedback

We display personal testimonials and feedback of satisfied customers on our site in addition to other endorsements. With your consent (see Terms of Service, Section 6, Part B), we may post your testimonial, or feedback, along with information such as your first name, last name initial, and city and state of residence. If you wish to update or delete your testimonial or feedback, you can send the request to support@1040.com.

Do Not Track Signals

There is no uniform or consistent standard or definition for responding to, processing, or communicating Do Not Track signals. At this time Our Web Sites and Services do not function differently based on a user's Do Not Track signal. Security

The security of your personal information is important to us. When you enter sensitive information (such as a credit card number) on Our Web Sites and Services, we encrypt the transmission of that information using secure socket layer technology (SSL).

Correcting and Updating Your Personal Information

Drake acknowledges that you have the right to access your personal information. Upon request, we will provide you with information about whether we hold any of your personal information. To review, update or amend your personal information, or to request deletion of your personal information, or to request that we no longer use your information to provide you services, you may log into your account and make the appropriate changes in your account management center or you may contact us at support@1040.com. We will respond to your request within 30 days.

We will retain your information for as long as your account is active or as needed to provide you services.. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.  You may continue to receive marketing emails and newsletter emails even after you stop utilizing Our Web Sites and Services, unless you have opted out of receiving marketing emails and newsletter emails using the method described in the Choice/Opt-Out section of this Privacy Policy.

Notification of Privacy Policy Changes

We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Site prior to the change becoming effective.
